REASON FOR BLACKLISTING (CRE GUIDELINES)

OBJECTIVE  To identify parameters as solid grounds for blacklisting a remote contractor from future endorsements.

2024 BLACKLISTING CRITERIA IN PLACEMENT STAGE

1. Non-performanceRC's contract got terminated due to underperformance for 3 instances
2. RC MIA/AWOLBased on this SOP
3. Legal ComplianceAny act of breaking the terms set out in our MSA
4. Concealment/MisrepresentationAny act of changing the information on a document deliberately intending to mislead a person or company
5. Falsification of Documents/RecordsThe act of giving false statement on a matter regarded as true or material
6. Work AvoidanceA pattern of behavior where an individual actively avoids tasks or responsibilities related to their job. This behavior can manifest in various ways, such as procrastinating, spending excessive time on non-work activities, or creating distractions that prevent the completion of tasks
7. Brand Damaging BehaviorAn act of making false statement that is damaging to our company and/or stakeholder's reputation
8. AbsenteeismTo incur absence rate of above 6% for three consecutive months
9. Unethical Behavior/Lack of ProfessionalismConstitutes a formal aspect of organizational behavior that involves an idea centered on actions that exceed professional limits or standards. It denotes stuffy and rude practices that fracture the workplace's concealed behavior policies



1. Non-performance


If the RC's major cause of contract dissolution/contract cancellation is performance related for 3 instances, this is automatically grounds for blacklisting. Proper RCA should have been done as well in order to support client's claim on RC's underperformance.


Remote Staff sets a very high standard in terms of performance. Hence, promoting a lock-in period of 30 days to maximize training and ensure that the remote contractor undergoes a comprehensive and sufficient training and nesting period fostering a good head start.


2. RC MIA/AWOL 


If the RC is absent without any notice for a few days, CRE will follow this SOP and tag the candidate as Blacklisted on both the EOC Report as well as in BullHorn.


3. Legal Compliance


This pertains to any possible breach on our Service Agreement on the remote contractor's end. There are different versions of our SA and it's always best practice to check the corresponding SA to verify if the act goes against our terms and conditions.


4. Concealment/Misrepresentation


Concealment means that RC purposefully conceals information from Remote Staff to hide any valuable details by intentionally changing/altering documents intending to mislead the company and its client/s.


Misrepresentation involves actively providing incorrect information to Remote Staff and its clients such as qualifications or skills and previous work experiences.


5. Falsification of Documents/Records 


Falsification of documents is the act of changing the information on a document deliberately intending to mislead a person or company.


In the context of the workplace, this could be in circumstances where a remote contractor has forged their own personal documents to gain or retain their contract or where an employee fraudulently alters or amends workplace records, such as for economic gain or other form of advantage.


The falsification of personal documents including, for example, qualifications, accreditations, certifications or references, essentially refers to where an individual provides the company/client with fake documents pertinent to their initial job application or pre-employment screening, or ongoing suitability for a role. Another example could be providing falsified proof of eligibility to work documentation or a fake sick note.


Depending on the nature of the business or documents in question, hiring an individual who has lied or misled their client about the nature and extent of their education, skills or experience can have significant consequences for an organisation. This can lead to issues around professional liability and reputational damage, since the burden rests with the client and the company to ensure that a remote contractor is fit for the role they’ve been hired to do.


6. Work Avoidance


Work avoidance refers to deliberately refraining from completing a task. One might do so because the remote contractor feels disengaged or distracted or cannot focus for an entirely different reason. This attitude of avoidance is far more likely in a classroom or work setting than it is when it comes to completing hobbies or leisure activities.


Work avoidance can manifest in various ways such as binge-watching, playing games while logged in for work, use of mouse jiggler, logging off without informing both the client and Remote Staff.


7. Brand Damaging Behavior


Instances wherein the remote contractor will intentionally post hateful or derogatory comments and reviews about Remote Staff or their clients on social media and other public platforms despite the lack of supporting facts.


8. Absenteeism


Absenteeism is usually unplanned, for example, when someone falls ill, but can also be planned, for example during a PH public holiday or willful absence. Although we follow a 'No work, no pay' policy, each time RC is absent from work this also equates to a loss for Remote Staff. RCs are encouraged to offset those lost hours and also notify the company at least 24 hours before the start of their shift.
